U.TRANSFERT – General Terms and Conditions of Sale for Tourist Packages

1. Content of the Sales Contract

The General Terms and Conditions form an integral part of the travel contract, together with the package description and the booking confirmation. By confirming the purchase, the traveler accepts these terms on their own behalf and on behalf of all participants.

2. Legislative Sources

The sale of tourist packages in Morocco and abroad is governed by the Tourism Code (D. Leg. 79 of 23 May 2011), applicable Italian and international conventions (CCV Brussels, 23 April 1970), and other relevant civil laws.

3. Authorizations

All organizers and intermediaries must be authorized to operate under applicable regulations. Only authorized companies may use terms such as “travel agency,” “tour operator,” or equivalents.

4. Definitions

  • Travel Organizer: Provides tourist packages on a lump-sum basis, combining at least two elements such as transportation, accommodation, or other tourist services.

  • Intermediary: Sells or provides tourist packages on behalf of the organizer.

  • Tourist: Purchaser or participant entitled to use the services of the package.

5. Tourist Package

A tourist package combines at least two elements for a fixed price:

  • Transportation

  • Accommodation

  • Other tourist services not related to transport or accommodation (e.g., excursions, sightseeing)

Travelers are entitled to a copy of the sales contract and coverage under the Guarantee Fund.

6. Mandatory Information & Technical Sheet

  • U.TRANSFERT is registered at Moroccan Commercial Registry 39531.

  • Civil liability insurance is held with UnipolSai.

  • Tours are listed on www.utransfert.com and prices are in Euros, subject to exchange rates.

  • Cancellation penalties apply:

    • Up to 11 days before departure: 50%

    • 10–0 days before departure: 100%

  • Excursions purchased locally are not included in the package contract.

7. Bookings

Reservations must be completed using the proper contract form. Confirmation is effective only when the organizer sends an official acceptance. Special requests (mobility, dietary requirements) must be specified in advance.

8. Payments

  • An advance of 50% is required upon booking.

  • Full payment deadlines are indicated in the catalogue or contract.

  • Non-payment results in contract termination.

9. Prices

Package prices are stated in the catalogue or on the website and may change within 20 days of departure due to transport costs or currency fluctuations.

10. Modifications or Cancellations

  • No refunds if cancellation occurs due to insufficient participants, force majeure, or fortuitous events.

  • In other cases, the organizer may refund double the amount previously paid, within legal limits.

11. Consumer Withdrawal

  • Free withdrawal is allowed if:

    • Price increases exceed 10%

    • Significant modifications to essential contract elements occur

  • Otherwise, cancellation fees apply as above.

12. Substitutions

Tourists may assign their booking to another person if the organizer is notified at least 4 working days before departure and the substitute meets all requirements.

13. Consumer Obligations

Travelers must:

  • Verify visa, passport, and health requirements.

  • Follow local rules, regulations, and safety guidelines.

  • Provide accurate personal information and special requirements (pregnancy, disabilities, food intolerances).

14. Hotel Classification

Hotel ratings are based on official local authorities. In countries without official ratings, the organizer provides a catalogue description.

15. Liability

The organizer is responsible for damages unless caused by the traveler or third parties, force majeure, or unforeseeable events. The intermediary is only responsible for intermediary services.

16. Compensation Limits

Damage compensation is limited as per Consumer Code articles 94–95.

17. Assistance

The organizer must provide necessary assistance at its own expense, except when failure is due to the tourist or third-party unforeseeable events.

18. Complaints

All complaints must be submitted promptly, via registered mail within ten working days after returning from the trip.

19. Insurance

Travelers are advised to purchase insurance covering cancellation, accidents, baggage, and repatriation costs if not included in the package.


20. Guarantee Fund

The National Guarantee Fund reimburses travelers and covers repatriation in the event of bankruptcy of the organizer or seller.


Addendum – Single Tourist Services

Contracts for individual services (transport, accommodation, or other) are governed by CCV articles applicable to single services, not as a full package.
